Guidance to help you understand your options after a visa decline

If your temporary visa application is declined while you are in New Zealand, you may have one final opportunity to remain lawfully through a request for reconsideration.

Reconsideration is a time-critical pathway available only in limited circumstances. This guide explains when it applies, how it works, what evidence is required, common mistakes, and how Visa Matters can help.

RECONSIDERATION REQUESTS GUIDE – FAQ

It is only available if you:

  • Are physically in New Zealand
  • Hold, or recently held, a valid temporary visa (including an interim visa)
  • Apply within 14 days of the visa decline

Reconsideration is not available for residence visa applications or for applicants who are offshore.

  • Completing the reconsideration application
  • Preparing a detailed cover letter explaining why the decision should be reversed
  • Providing targeted supporting evidence, which may include updated documents, clarifications, or proof of error or special circumstances
  • Paying the reconsideration application fee

The request is submitted online or by post, depending on INZ requirements.

A different immigration officer will assess the reconsideration. The original decision maker does not review the case again.

  • Whether the original decision was correct
  • Whether new or additional evidence changes the outcome
  • Whether the decline was based on an error or misunderstanding
  • Whether special circumstances justify approval as an exception to policy

You must directly address the reasons given in the decline letter.

Insufficient funds or unclear source of funds

  • Incomplete or inconsistent documentation
  • Doubts about genuine intentions
  • Health or character concerns

Addressing these issues clearly and with strong evidence is critical.

  • INZ may request further information or clarification
  • Processing usually takes around 2 to 6 weeks, depending on complexity

If your visa expires while the reconsideration is under review, you will be unlawfully in New Zealand. However, you cannot be deported while the reconsideration is being assessed.

If approved, you will be issued a visa as if it had been granted originally.

If declined, your next steps depend on your visa status and may include reapplying for a temporary visa or leaving New Zealand.

  • You only get one chance to request reconsideration
  • Weak or rushed submissions can damage credibility
  • If you are already unlawful, reconsideration is not available and a Section 61 request may be required
